Store products

1.All products on EasyBed Online Store are new and manufacturer’s guaranteed or its authorized representative in Poland.

2.All products on EasyBed Online Store are brand new, free from physical and legal defects, and have been legally placed on the Polish/UE market.

3.All mentioned products and names are used for identification and may be registered trademarks.

4.All EasyBed Online Store products are imported in accordance with the customer’s order, the waiting period for the product is always posted on the product page.

Conditions for placing an order

5.The customer of EasyBed Online Store can only be person with full or limited legal capacity or a legal person.

6.The customer can place orders 7 (seven) days a week and 24 (twenty four) hours a day via the website https://easybed.eu. The customer after registering and logging in to the website, places the order, indicating the product he is interested in, by selecting the “ADD TO CART” command on the product page, and then indicating the method of collection and payment in Shopping Card, and confirming the order.

7.Customer indicates in the Shopping Card:

(a) the products ordered;
(b) the address to delivery and the data necessary for issuing the invoice;
(c) delivery method;
(d) payment method;
(e) accepts the processing of personal data by ABAR Eksport-Import Bogdan Kamiński.

8.The ordering includes the commands ‘ADD TO CART’, ‘CONTINUE PURCHASE’, ‘COMPLETE ORDER’, ‘FINALIZE ORDER (CHECKOUT)’, ‘CHOOSE THIS SHIPMENT’, ‘BUY AND PAY’. The customer places an order by selecting the command “BUY AND PAY”. Placing an order is the submission by the customer of EasyBed Online Store an offer to conclude a contract for the sale of the products subject to the order.

9.After placing the order, the EasyBed Online Store sends to the e-mail address provided by the customer, confirmation of the registration of the order along with the pro forma invoice and regulations of the store. Confirmation of order registration is EasyBed Online Store’s statement of acceptance of the offer.

10.The object of the order can be delivered to the customer or picked up in person, depending on his choice:

(a) to the address provided by the customer in the order;
(b) personal pickup at Abar Home

11.Prices of shipment depend on the type of ordered goods; information about the cost of shipping is shown in the Shopping Card, after adding products.

12.The term of the execution depends on the type of product and is given each time for each product.

13.In the lack of the ordered product or the inability to process the order for other reasons, (including if the purchase of them from the suppliers of EasyBed Online Store will not be possible within the time prescribed for the order), EasyBed Online Store will inform the customer about it by sending a message to the indicated by customer’s e-mail address or will provide information by phone call  (number provided by the customer).

14.If the execution of order is not possible, EasyBed Online Store may offer the customer:

(a) canceling the entire order (if this option is selected by the customer, EasyBed Online Store will be released from the obligation to process the order);
(b) canceling the order in a part in which the execution is not possible within the prescribed period (if the customer chooses this option, the order will be carried out in part, with EasyBed Online Store being released from the obligation to fulfill it in the remaining scope);
(c) dividing the order and setting a new deadline for the part of the contract that cannot be completed by the originally set deadline (if this option is selected by the customer, the products included in the order will be sent in several separate shipments, and the customer will not incur additional costs associated with splitting the order into several shipments).

15.If the ordered product is not in stock or the customer’s order cannot be processed for other reasons, EasyBed Online Store has the right to withdraw from the sales contract within 14 (fourteen) days. If payment for the subject of the order has been made in advance – the EasyBed Online Store will refund the amount paid to the customer within 7 (seven) days from the date of sending the statement of withdrawal from the contract.

Start of order processing and payment method

1.The order begins when the transfer is posted to the account, receipt of payment by credit/payment card or transfer via Przelewy24.pl service, or the customer signs a credit agreement with one of the credit companies.

2.The condition for starting the implementation of the order by EasyBed Online Store is the payment by the customer of a minimum deposit of 30% of the value of the order placed.

The payment is made upon receipt of the product, prepayment to the bank account, by credit / payment card or by bank transfer via Przelewy24.pl or by courier – depending on the payment method chosen by the customer.

All bank deposits should be made to the Store’s bank account number.

A receipt or VAT invoice is issued for each order. The sales document is delivered together with the parcel or will be sent via Poczta Polska to the address indicated as the shipping address of the goods or other, indicated by the customer for correspondence.

Product prices

1.EasyBed Online Store publishes product information on the www.easybed.eu website and sells the abovementioned products via the Internet.

2.Prices on EasyBed Online Store website next to the product:

(a) they include VAT and are given in Euro;
(b) do not contain information on shipping costs;
(c) do not contain information on any customs duties if the goods are shipped outside of Poland/UE.

3.Final price is the price of the product given on EasyBed Online Store website at the time of placing the order by the customer.

4.Information about the price of the shipment is given in Shopping Card, it depends on the amount of goods and the chosen option of delivery or personal pickup.

5.There are no fees for personal pickup.

6.Information on the total value of the order is presented in Shopping Card after the customer chooses the form of delivery of the item.

7.EasyBed Online Store reserves the right to make changes in product prices and to carry out and cancel all types of promotional campaigns and sales. The entitlement referred to in the previous sentence does not affect orders placed before the date of entry into force of the price change, terms of promotional campaigns or sales.

Order modification

Customer may make changes to the order until EasyBed Online Store sends the shipment with the subject of the order to the customer. The changes may apply only to the resignation from all or part of the products making up the order, changes in the delivery address or changes in the invoice data. In the event of cancellation of the order, if payment has been made in advance, the refund will be made within 7 (seven) days of receipt of the resignation.

Complaints 

1.Customer has the right to complain within 2 (two) years from the date of delivery of the subject of the order, if the complaint concerns furniture elements.

2.Customer has the right to complain within 10 (ten) years from the date of delivery of the subject of the order, if the complaint concerns the mechanism of the furniture or mattress (Amber Dream Sembella model – purchased via EasyBed Online Store).

3.Customer has the right to warranty within 2 (two) years from the date of delivery of the subject of the contract.

4.EasyBed Online Store will respond to the customer’s complaint and inform about the way to proceed within 14 (fourteen) days after receving customer’s complain.

5.Only complaints sent in writing will be considered.

6.If complaint is accepted, EasyBed Online Store may repair, replace, reduce the price or return the equivalent of the purchased product or replace the advertised product within 14 (fourteen) days from the date of consideration of the complaint. The choice of option depends on the customer’s decision.

Cancellation of the order and withdrawal

1.Customer may cancel the order if the products comprising it have not yet been shipped:

(a) by contacting Customer Service of EasyBed Oline Store
(b) by sending information via e-mail

2.Customer who is a person making purchases in EasyBed Online Store for activities not directly related to his business or professional activity may return without giving reasons within 14 (fourteen) days of receiving the order, each product ordered in EasyBed Online Store, except for products made on a special client’s order.

3.Customer referred to in paragraph 2 (above) may return the purchased products, in accordance with the principles described in this paragraph, if within 14 (fourteen) days from the date of receipt of the subject of the order he makes a statement of withdrawal from the contract and returns the goods. Withdrawal of the order in the case of a custom-made product is not possible.

4.Customer referred to in paragraph 2 (above), may return the subject of the contract in whole selected part:

(a) personal pickup at the Abar Salon – during collection of the order or within 14 (fourteen) days of receipt of it,
(b) courier service – returned products should be sent to the following address: Abar Home, ul. Podgórna 11a, 05-074 Nowy Konik, Poland

5.When the withdrawal from the contract comes from the customer, the client bears the costs of delivering the order.

6.All payments between the parties are made by payment of a nominal amount expressed in Euro.

7.EasyBed Online Store does not receive parcels sent to it on delivery and is not responsible for the costs associated with such shipments.

8.EasyBed Online Store shall refund within 7 (seven) calendar days in the event of a return of goods in accordance with paragraph 2.

Personal data

1.Providing personal data by the customer is voluntary, but necessary to register and process customer orders in EasyBed Online Store.

2.Personal data provided by the customer will be processed to enable the customer to use the store, including the implementation of the order. Customer data will also be processed for marketing purposes, including to send information on new products, services and promotions offered by theEasyBed Online Store.

4.The data administrator is not responsible for providing false personal data by the customer.

5.Customers of EasyBed Online Store have the right to inspect their personal data, correct it and request its removal.

Final Provisions

1.Product information posted on EasyBed Online Store does not constitute an offer within the meaning of the Civil Law.

2.EasyBed Online Store is not responsible for interruptions in the use of the EasyBed Online Store for technical reasons (maintenance, inspection, replacement of equipment, etc.) or other reasons beyond its control.

3.EasyBed Online Store is not responsible for the blocking by mail server administrators of sending messages to the e-mail address provided by the customer and for the removal and blocking of e-mails by software installed on the computer used by the customer.

4.The differences between the visualization of the product available in EasyBed Online Store resulting from the individual settings of the client’s computer (color, proportions, etc.) cannot be the basis for a complaint.

5.In matters not regulated in the regulations, the provisions of Polish law shall apply, in particular the Civil Code and the Act on special conditions of consumer sales and amendment of the Civil Code (Dz.U.No. 141/2002, item 1176) and the Act on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Dz.U.No. 22/2000, item 271).

6.All product names posted on EasyBed Online Store website are used for identification purposes and may be protected and reserved under the provisions of the Industrial Property Law Act (Dz.U. No. 119/2003, item 1117).

These Regulations apply from May 15, 2018.

7.EasyBed Online Store reserves the right to change the regulations. Changing the regulations becomes effective within the time limit indicated by the store, not less than 7 days from the moment of making the amended regulations available on the easybed.eu website. Orders placed by customers before the changes in the store regulations are implemented according to the existing provisions of the regulations.
